Assumption of Risk
By registering for and participating in any ONZE event, activity, or session (collectively, "Events"), you acknowledge and agree that pickleball and related physical activities involve inherent risks of injury, including but not limited to: sprains, strains, fractures, dislocations, concussions, heat-related illness, cardiac events, and other bodily harm. These risks may result from your own actions, the actions of other participants, venue conditions, equipment, or other causes.
You understand that these risks cannot be fully eliminated regardless of the care taken to avoid them, and you voluntarily assume all such risks, both known and unknown, even if arising from the negligence of ONZE, its officers, members, agents, volunteers, or other participants.
Waiver & Release of Liability
In consideration of being permitted to participate in any ONZE Event, you hereby waive, release, and forever discharge ONZE, its owners, officers, directors, members, employees, agents, volunteers, sponsors, affiliates, successors, and assigns (collectively, "Released Parties") from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, whether known or unknown, arising out of or in connection with your participation in any Event, including but not limited to:
- Personal injury, illness, or death
- Property damage or theft
- Negligence of the Released Parties
- Conditions of any venue, court, or facility used for Events
- Actions or omissions of other participants, guests, or third parties
This release applies to claims arising before, during, or after any Event, and covers travel to and from Events.
Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, lawsuits, demands, damages, costs, expenses (including reasonable attorneys' fees), and liabilities brought by you, your heirs, estate, or any third party arising from your participation in any Event or your breach of this Agreement.
Medical Acknowledgment
You represent and warrant that:
- You are physically fit and have no medical condition that would prevent safe participation in pickleball and related physical activities
- You have not been advised against physical activity by a medical professional
- You will immediately cease participation and notify ONZE staff if you experience any symptoms of illness, injury, or distress during an Event
- You are solely responsible for determining your fitness to participate
Emergency Medical Authorization
In the event of an emergency, you authorize ONZE and its agents to seek and consent to emergency medical treatment on your behalf if you are unable to do so. You understand that any medical costs incurred are your sole financial responsibility and are not the responsibility of ONZE or any Released Party.
Media Release & Consent
You grant ONZE and its authorized representatives a perpetual, worldwide, royalty-free, irrevocable license to:
- Photograph, film, record, and otherwise capture your image, likeness, voice, and actions during any Event
- Use, reproduce, distribute, display, and publish such content in any medium or format, including but not limited to: the ONZE website, social media accounts, marketing materials, promotional content, press coverage, and merchandise
- Edit, modify, or alter such content at ONZE's sole discretion
You waive any right to inspect or approve the use of your image, any claim for compensation related to the use of your image, and any claims related to invasion of privacy, right of publicity, defamation, or copyright infringement arising from use of such content.
If you do not wish to be photographed or recorded at an Event, you must notify ONZE staff in writing prior to the Event. ONZE will make reasonable efforts to accommodate such requests but cannot guarantee complete exclusion from incidental capture.
Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any dispute arising under this Agreement shall be resolved exclusively in the courts of Los Angeles County, California. You waive any objection to jurisdiction or venue in such courts.
Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Acknowledgment
By checking the agreement box during event registration, you confirm that you have read, understood, and voluntarily agreed to all terms of this Waiver, Release & Media Consent. This agreement is binding upon you, your heirs, executors, administrators, and assigns. You understand that you are giving up substantial legal rights, including the right to sue for damages in the event of injury, and have signed this agreement freely and voluntarily.
This agreement remains in effect for all current and future ONZE Events unless you provide written notice of revocation to hello@onzeclubla.com.
